Small Facilities Urged to Recheck Hazardous Waste Practices
Businesses, schools, and other small generators are encouraged to review hazardous waste handling to prevent violations and protect public health.

The EPA is encouraging small businesses, schools, and other facilities to closely review how they manage hazardous waste, citing a recent pattern of unintentional violations.
EPA Region 2, which includes New York, New Jersey, Puerto Rico, and the U.S. Virgin Islands, has identified common compliance gaps, particularly facilities failing to obtain an EPA identification number before shipping regulated amounts of hazardous waste.
“Many of these violations stem from misunderstanding, not malice,” said EPA Regional Administrator Michael Martucci. “We want to make sure businesses understand their legal obligations and take proactive steps to handle hazardous waste properly. It’s about protecting human health and the environment — and helping companies avoid costly mistakes.”
To support compliance, the EPA is offering Expedited Settlement Agreements (ESAs), a streamlined enforcement option that helps facilities correct violations with minimal penalties.
“If you run a small business, you may be generating more hazardous waste than you think,” Martucci added. “We’re here to help you get it right, because the rules protect both your workers and your community.”
Who’s Affected?
Facilities that generate hazardous waste—such as used solvents, expired chemicals, or disinfectants—may be subject to strict federal requirements. This includes:
- Auto repair shops
- Medical and dental clinics
- Art and science programs
- Laboratories and print shops
- Schools and universities
Facilities generating over 100 kilograms (220 pounds) of hazardous waste per month must notify the EPA and comply with specific labeling, storage, and shipping rules. Even smaller generators have legal obligations, including proper container labeling and safe storage practices.
What the EPA Recommends
To avoid enforcement actions and support workplace and community safety, EPA recommends that facilities:
- Monitor their monthly hazardous waste output
- Apply for an EPA ID using Form 8700-12 if over 100 kg/month is generated
- Follow rules for labeling, storing, and transporting hazardous waste
- Consult EPA’s hazardous waste guidance regularly
