TCEQ Fines DCP Midstream, Citgo Refining for Records' Review Issues
Some of the penalty money will support supplemental environmental projects on clean school buses and tire cleanup.
The Texas Commission on Environmental Quality on Feb. 23 approved penalties totaling $1,976,497 against 91 regulated entities for violations of state environmental regulations.
Agreed orders were issued in the following enforcement categories:
- 22 air quality,
- 2 Edwards Aquifer,
- 1 industrial or hazardous waste,
- 5 industrial waste discharge,
- 4 multimedia,
- 10 municipal waste discharge,
- 1 onsite sewage facility installer,
- 18 petroleum storage tank,
- 8 public water system,
- 3 water quality, and
- 1 water rights order.
There were two field citations.
Penalties also were assessed in two petroleum storage tank cases following hearings at the State Office of Administrative Hearings.
Included in the total are two fines totaling $1,046,315 against DCP Midstream in Crockett and Ector counties stemming from a records review conducted June, 2009 and March, 2010. Of that total, $523,157 will be used as a supplemental environmental project (SEP) contribution to the Texas PTA, Clean School Bus Program in the Midland, Odessa, and San Angelo area. Also included in the total was a fine of $303,294 against Citgo Refining, Nueces County, stemming from a records review and an emergency discharge event. Of that total, $151,647 will be used as a SEP contribution to the Texas Association of Resource Conservation and Development Areas Abandoned Tire Cleanup in Nueces County.
