Facilities Must Update SPCC Plans by November 2010

The U.S. Environmental Protection Agency twice this year extended the deadline for facilities to amend or prepare and implement their Spill Prevention Control and Countermeasure (SPCC) plans to comply with revisions made to the Clean Water Act rule since 2002.

On June 19, the EPA published in the Federal Register a SPCC compliance date extension until Nov. 10, 2010. The ruling also applies to farms.

On April 1, the Federal Register published EPA's delay of the effective date of the December 5, 2008, SPCC final rule. This delay was in response to public comments and the Office of Management and Budget's Jan. 21 memorandum regarding regulatory review.

Neither delay removes any regulatory requirement to maintain an SPCC plan in accordance with the SPCC regulations for owners or operators of facilities in operation before Aug. 16, 2002.
