CEI Lawsuit Seeks Climate Science Data Disclosure from NASA

The Competitive Enterprise Institute (CEI) said it filed a lawsuit (pdf) on May 27 to force NASA to produce records related to last year's "ClimateGate" scandal ─ records the agency has refused to produce for nearly three years.

In its complaint, CEI calls for government transparency about climate science, "particularly now, when debate about climate change and ‘cap and trade’ legislation has captured sustained national attention.”

The lawsuit arises out of three CEI Freedom of Information Act (FOIA) requests, initiated in August 2007 and originally seeking internal documents about NASA improperly boosting U.S. temperature data in this decade. Five months after the first request, CEI sought documents concerning Gavin Schmidt, Ph.D., a taxpayer-funded NASA researcher who, chief among other NASA scientists, spends working hours running and writing for a third-party Website (RealClimate.org).

After CEI submitted this request, timestamps were retroactively removed from Real Climate posts, the organization says. CEI is presenting the court with original Website postings that establish how NASA facilities and staff, at taxpayer expense, are being employed to push a specific policy agenda.

The lawsuit was filed in the U.S. District Court for the District of Columbia. CEI is represented by Andrew S. Tulumello of Gibson, Dunn and Crutcher, which is handling the lawsuit pro bono.

The science is very straightfoward and the evidence on planetary weather and ocean changes are evident.This pogrom to discredit and create doubt will only cause a greater crisis in our children or grandchildren's lives.We are seeing the damage our irresponsible overuse of fossil fuels.

Cudos to Gibson, Dunn and Crutcher for taking up the case pro bono. But wait, are we sceptics not supposed to be 'well funded shills of the oil industry"? It is a deep shame to see NASA fall to blocking lawful requests like dodgy criminals. The management should be sacked to the last man. NASA was supposed to help humanity reach for the stars with pride and confidence. Instead we loath ourselves as a cancer on Gaia and shadows painted by green speculators

One day, people will realize that NASA, EPA, DOE, etc. are corrupted by politics and no longer have much credibility when it comes to science and engineering. The top personnel are simply political appointments, which means they owe something to somebody.

Removing the timestamps is prima facie evidence of a conspiracy to defraud the taxpayer and shows intent to obstruct justice. If the FBI were doing its job, there would be criminal charges against Gavin. If NASA was acting appropriately, it would have terminated Gavin for cause. In the long term, Gavin's actions will have negative affect on funding for the space agency.
